Terms of Service

Public Terms of Service. Homexus also maintains a contractor-specific version (below) that applies when you use Homexus as a contractor.

1. Acceptance & Eligibility

By creating an account, checking "I agree," or using Homexus, you agree to these Terms. You must be at least 18 years old and able to enter a binding contract.

2. What Homexus Is — and Is Not

Homexus is a technology platform and information tool that helps homeowners organize their home and connect with independent contractors. Homexus is a neutral intermediary only. Homexus is not a contractor, home-service provider, general contractor, broker, agent, employer, or partner of any contractor, and does not perform, supervise, direct, or control any work. Homexus is not a party to any agreement, quote, estimate, or transaction between you and a contractor. Every such agreement is solely between you and the contractor.

3. Verification Is a Limited Check — Not a Guarantee, Not a Background Check

Homexus performs a basic, point-in-time review of certain contractor-submitted documents such as a trade license and certificate of insurance. You acknowledge this is NOT: a guarantee of any contractor's honesty, quality, competence, safety, or reliability; a criminal background check, identity check, or reference check — Homexus does not perform background checks and makes no representation about any contractor's criminal history or character; ongoing verification, as documents may lapse after review; or an endorsement or warranty of any contractor. A "Verified" badge means only that a contractor submitted documents that appeared facially valid at one point in time. It is not a substitute for your own investigation.

4. Your Due Diligence and Assumption of Risk

You are solely responsible for independently vetting any contractor before hiring, communicating with, allowing into your home, or paying them — including checking references, confirming licensing and insurance directly with issuing authorities, agreeing scope and price in writing, and confirming completion before payment. You knowingly and voluntarily assume all risks of selecting a contractor, of allowing any person onto your property, and of the work performed, including property damage, theft, injury, defective work, non-performance, delay, and fraud.

5. Payments Are Between You and the Contractor

Homexus does not process, hold, escrow, guarantee, or collect payments between homeowners and contractors. All pricing, deposits, and payment are arranged and completed directly between you and the contractor. Homexus is not responsible for any payment, deposit, refund, overcharge, non-payment, or payment dispute.

6. Disputes and Release

Any dispute, claim, damage, or loss arising out of or relating to a contractor, their work, conduct, or any transaction is solely between you and the contractor. You agree to pursue it directly with the contractor and release Homexus and its owners, officers, and affiliates from any and all such claims, known or unknown. Homexus has no duty to mediate, and any voluntary assistance does not create liability.

7. Safety and Emergencies

Homexus is not an emergency service. For emergencies such as gas leaks, fire, active flooding, or electrical hazards, call 911 and the appropriate utility or authority. Do not rely on the platform, notifications, or AI features for urgent or safety-critical situations. You are responsible for securing valuables, disclosing hazards, and taking reasonable precautions when any person is at your property.

8. AI Features and Information — No Professional Advice

The platform, including AI Home Expert, maintenance suggestions, cost estimates, and information, is informational only and is not professional, engineering, legal, financial, or safety advice. Do not rely on it for structural, electrical, gas, or code-compliance decisions — consult a qualified licensed professional. AI output may be inaccurate or incomplete.

9. Reviews and User Content

If you post reviews, photos, or other content, you grant Homexus a non-exclusive, royalty-free license to use and display it in connection with the service. You are responsible for your content; it must be truthful, lawful, and non-defamatory. Homexus does not endorse and is not responsible for any user content, review, or rating, and may remove content at its discretion.

10. Acceptable Use

You agree not to provide false information, use the platform for fraud, harassment, or unlawful purposes, circumvent verification, scrape or misuse data, or interfere with the service. Homexus may suspend or terminate accounts that violate these Terms.

11. Disclaimer of Warranties

THE PLATFORM AND ALL FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. Homexus does not warrant any contractor, work, or outcome.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMEXUS AND ITS OWNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, PROPERTY DAMAGE, OR PERSONAL INJURY ARISING FROM CONTRACTOR CONDUCT OR WORK. HOMEXUS'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID HOMEXUS IN THE PRIOR TWELVE MONTHS OR ONE HUNDRED DOLLARS ($100).

13. Indemnification

You agree to indemnify, defend, and hold harmless Homexus and its owners, officers, and affiliates from any claims, damages, liabilities, costs, and attorneys' fees arising from your use of the platform, your dealings or disputes with any contractor, your content, or your violation of these Terms or any law.

14. Binding Arbitration and Class-Action Waiver

Any dispute between you and Homexus will be resolved by binding individual arbitration, not in court. You and Homexus waive the right to a jury trial and waive the right to participate in a class action or class-wide arbitration. Either party may bring an individual claim in small-claims court. You may opt out of this arbitration provision by emailing legal@homexus.com within 30 days of first accepting these Terms.

15. Privacy

Your use is also governed by the Homexus Privacy Policy. You consent to receive service-related communications.

16. Changes and Termination

Homexus may modify these Terms; material changes will be presented for re-acceptance, and continued use constitutes acceptance. Homexus may suspend or terminate access at its discretion.

17. General

These Terms are governed by the laws of the State of New Jersey. If any provision is unenforceable, the remaining provisions stay in effect. These Terms are the entire agreement between you and Homexus regarding the platform. Sections 3–14 survive termination. Questions: legal@homexus.com.

1. Acceptance & Eligibility

By creating a contractor account, checking "I agree," or using Homexus, you agree to these Terms. You must be at least 18 and authorized to bind your business.

2. What Homexus Is — and Is Not

Homexus is a technology platform that helps independent contractors connect with homeowners and manage service requests. Homexus is a neutral intermediary and software tool only. Homexus is not your employer, partner, agent, client, or general contractor, does not assign or guarantee work, does not guarantee payment, and does not control how or whether you perform any work. You are an independent contractor. Your relationship with any homeowner is solely between you and that homeowner.

3. Independent Contractor Status; Taxes; Personnel

Nothing here creates an employment, agency, partnership, or joint-venture relationship. Homexus provides no wages, benefits, workers' compensation, or insurance to you. You are solely responsible for all taxes and for any required tax filings. You are solely responsible for your own employees and subcontractors, including their conduct, wages, insurance, and compliance, and you ensure anyone working under you is properly authorized, licensed, and insured.

4. Your Licensing, Insurance, and Legal Compliance

You represent, warrant, and covenant that you hold and will maintain current all licenses, permits, bonding, and insurance required for your trade and jurisdiction; will promptly notify Homexus and update your profile if any lapses, expires, or is revoked; will perform all work competently, safely, and in compliance with all applicable laws and codes; and will obtain all required permits. Homexus's verification of your documents is a basic point-in-time check and is not an endorsement, guarantee, or assumption of responsibility for your credentials, work, or compliance.

5. You Vet Jobs and Homeowners at Your Own Risk

You are responsible for evaluating each job and homeowner before accepting — confirming scope, agreeing price and payment terms in writing, and satisfying yourself as to the homeowner's identity and ability to pay. Homexus does not guarantee that any homeowner will pay, that any job is accurate, or that any homeowner is legitimate. You accept jobs at your own risk.

6. Payment Is Between You and the Homeowner

Homexus does not process, hold, escrow, guarantee, or collect payment. All invoicing and collection are handled directly between you and the homeowner. Homexus is not responsible for non-payment, underpayment, deposits, refunds, chargebacks, or any payment dispute. Collecting payment is your responsibility.

7. Your Work Is Yours

You are solely responsible for the quality, safety, warranty, permitting, and outcome of your work, and for any damage or injury arising from it. Any warranty you offer runs between you and the homeowner. Homexus makes no warranty regarding your work and is not liable for it.

8. Disputes and Release

Any dispute with a homeowner is solely between you and the homeowner. You release Homexus and its owners from any and all such claims, including for lost jobs, lost income, non-payment, or homeowner conduct.

9. Profile, Content, and License to Display

You authorize Homexus to display your business name, trades, service area, bio, photo, and verification status to homeowners. You represent all information and documents you submit are true and current. You grant Homexus a license to use your submitted content to operate and promote the service.

10. Acceptable Use

You agree not to submit false or forged credentials, misrepresent your services, harass users, or use the platform unlawfully. Violations may result in immediate removal.

11. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS, ACCURACY, LEAD VOLUME, OR UNINTERRUPTED OPERATION. Homexus does not guarantee any number of jobs, clients, income, or results.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMEXUS AND ITS OWNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST JOBS, LOST PROFITS, OR LOST DATA. HOMEXUS'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE FEES YOU PAID HOMEXUS IN THE PRIOR TWELVE MONTHS OR ONE HUNDRED DOLLARS ($100).

13. Indemnification

You agree to indemnify, defend, and hold harmless Homexus and its owners, officers, and affiliates from any claims, damages, liabilities, costs, and attorneys' fees arising from your work; your conduct or that of your employees or subcontractors; property damage or injury you cause; your licensing, insurance, or tax status; your dealings or disputes with any homeowner; your content; or your violation of these Terms or any law.

14. Binding Arbitration and Class-Action Waiver

Any dispute between you and Homexus will be resolved by binding individual arbitration, not in court. You and Homexus waive the right to a jury trial and to participate in any class action or class-wide arbitration. Either party may bring an individual claim in small-claims court. 15. Suspension and Termination

Homexus may suspend or remove any contractor at its discretion, including for false information, lapsed credentials, complaints, safety concerns, or Terms violations, with or without notice.

16. Privacy and Communications

Governed also by the Homexus Privacy Policy. You consent to service-related communications.

17. General

These Terms are governed by the laws of the State of New Jersey. If any provision is unenforceable, the remaining provisions stay in effect. These Terms are the entire agreement regarding the platform. Sections 3–15 survive termination. Questions: legal@homexus.com.
